Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Hugo Moriceau ("we", "us", or "our"), the developer of PicSwipe ("App", "Service", or "Application").

By accessing or using PicSwipe, you confirm that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws

2. Description of Service

PicSwipe is a mobile application designed to help users organize and clean their photo libraries by:

• Identifying and removing duplicate photos
• Detecting similar or blurry images
• Filtering photos by date and location
• Managing photo storage efficiently
• Providing photo review and deletion tools

All photo processing occurs locally on your device. We do not upload, store, or access your photos on external servers.

3. License Grant

3.1 Free Version

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the free version of PicSwipe for personal, non-commercial purposes with the following limitations:

• Maximum 15 photo reviews per day
• Basic photo cleaning features
• Limited filter options

3.2 Premium Subscription

If you purchase a Premium subscription, you receive an additional license for:

• Unlimited photo reviews per day
• Advanced location-based filtering
• Date range filtering
• Priority customer support
• Access to all future premium features

4. Subscription Terms

4.1 Free Trial

Premium subscriptions include a 3-day free trial period. You will not be charged during the trial period. If you do not cancel before the trial ends, you will automatically be charged the subscription fee.

4.2 Subscription Fee

The Premium subscription costs $4.99 USD per week (or equivalent in your local currency). Prices are subject to change with 30 days notice.

4.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the period ends. You will be charged through your Apple App Store account.

4.4 Cancellation

You may cancel your subscription at any time through your App Store account settings:

1. Open the Settings app on your device
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select PicSwipe
5. Tap "Cancel Subscription"

Cancellation takes effect at the end of the current billing period. You will retain Premium access until then.

4.5 No Refunds

All purchases are final. We do not offer refunds for:

• Partial subscription periods
• Unused portions of the service
• Subscriptions canceled during a billing period

Refund requests should be directed to Apple App Store support, as all payments are processed through Apple.

5. User Responsibilities

5.1 Prohibited Uses

You agree NOT to:

• Reverse engineer, decompile, or disassemble the app
• Remove or modify any copyright, trademark, or proprietary notices
• Use the app for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the app
• Interfere with or disrupt the app's functionality
• Use automated systems or bots to access the app
• Resell, sublicense, or distribute the app

5.2 Photo Management Responsibility

IMPORTANT: You are solely responsible for:

• Backing up your photos before using PicSwipe
• Reviewing photos before deletion
• Managing your device's storage
• Verifying that deleted photos are moved to your device's Recently Deleted folder

6. Intellectual Property Rights

6.1 App Ownership

PicSwipe, including all content, features, functionality, source code, and design, is owned by Hugo Moriceau and is protected by:

• International copyright laws
• Trademark laws
• Patent laws
• Trade secret laws

6.2 Your Content

You retain all rights to your photos. We do not claim any ownership or rights to your photos. You grant us only the necessary permissions to process your photos locally on your device to provide the Service.

7. Disclaimers and Limitations of Liability

7.1 "AS IS" Basis

PicSwipe is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability
• Uninterrupted or error-free operation

7.2 No Warranty for Photo Loss

WE DO NOT GUARANTEE:

• The app will correctly identify duplicate or similar photos
• Deleted photos can be recovered
• The app will not malfunction
• Your device's storage will be managed perfectly

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of photos or data
• Loss of profits or revenue
• Loss of goodwill
• Device damage
• Any other intangible losses

Our total liability shall not exceed the amount you paid for the Premium subscription in the 12 months preceding the claim, or $50 USD, whichever is less.

8. Indemnification

You agree to indemnify, defend, and hold harmless Hugo Moriceau and PicSwipe from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the app
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws

9. Privacy and Data Protection

Your use of PicSwipe is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

Key Privacy Points:

• All photo processing happens locally on your device
• We do not upload, store, or access your photos
• We collect minimal anonymous usage data
• We comply with GDPR and CCPA regulations

10. Third-Party Services

10.1 Apple App Store

Your use of PicSwipe is subject to Apple's App Store Terms of Service. Payment processing and subscription management are handled by Apple.

10.2 Acknowledgments

You acknowledge that:

• These Terms are between you and Hugo Moriceau, not Apple
• Apple has no obligation to provide support for the app
• Apple is not responsible for any claims related to the app
• Apple is a third-party beneficiary of these Terms

11. Updates and Modifications

11.1 App Updates

We may release updates to improve functionality, fix bugs, or add features. You should install updates promptly. We are not liable if you do not install updates.

11.2 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• In-app notification
• Email (if we have your email)
• Updating the "Last updated" date

Your continued use after changes constitutes acceptance of the modified Terms.

12. Termination

12.1 Termination by You

You may terminate these Terms at any time by:

• Canceling your subscription
• Uninstalling the app
• Ceasing all use of the Service

12.2 Termination by Us

We may terminate or suspend your access immediately, without notice, if you:

• Violate these Terms
• Engage in fraudulent activity
• Use the app for illegal purposes
• Abuse or reverse engineer the app

12.3 Effect of Termination

Upon termination:

• Your license to use the app ends immediately
• You must cease all use and uninstall the app
• No refunds will be provided for unused subscription periods
• Sections that should survive termination will remain in effect

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of France and the European Union, without regard to conflict of law principles.

13.2 Arbitration

Any disputes arising from these Terms or your use of PicSwipe shall be resolved through binding arbitration, except for:

• Small claims court matters
• Intellectual property disputes
• Injunctive relief

13.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

14. Geographic Restrictions

PicSwipe is available worldwide through the Apple App Store, subject to your local laws and Apple's distribution policies. You are responsible for compliance with local laws.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hugo Moriceau regarding PicSwipe and supersede all prior agreements and understandings.

17. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

18. Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

20. Acknowledgment

BY USING PICSWIPE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM.
