These Terms of Use ("Terms") govern your use of the SKYGATE flight-tracking app for iOS ("the app"), published by Hugo Moriceau. By downloading or using SKYGATE, you agree to these Terms. If you do not agree, please do not use the app.

Please read sections 4 and 5 carefully. Flight information in SKYGATE comes from third-party providers and may be inaccurate or delayed — it is not a substitute for your airline's official information, which you should always confirm before travelling. AI Rescue compensation figures are non-binding estimates, not legal advice, and SKYGATE does not pay compensation or pursue claims. You use this information at your own risk.

1. License to use

We grant you a personal, non-exclusive, non-transferable, revocable license to use SKYGATE on Apple devices you own or control, in accordance with the Apple Media Services / App Store Terms and these Terms. You may not copy, reverse-engineer, resell, or redistribute the app except as permitted by law.

2. Subscriptions & auto-renewal

SKYGATE is free to track up to 3 flights. Premium unlocks unlimited tracking and all premium features and is offered as an auto-renewing subscription:

Auto-renewal: Subscriptions are purchased and billed through your Apple ID. Payment is charged at confirmation of purchase, and the subscription renews automatically at the same price unless you cancel at least 24 hours before the end of the current period (including the free-trial period). Your Apple ID is charged for renewal within 24 hours prior to the end of the period. Any unused portion of a free trial is forfeited when you purchase a subscription.

You can manage or cancel your subscription anytime in Settings → [your name] → Subscriptions on your device. Pricing may vary by region and is shown in your local currency at purchase. SKYGATE never receives or stores your payment details — all billing is handled by Apple.

3. Refunds

Because purchases are processed by Apple, refunds are subject to Apple's policies and are requested through Apple at reportaproblem.apple.com. We are generally unable to issue refunds directly.

4. Flight data is informational — not authoritative

SKYGATE displays flight information — schedules, gates, terminals, departure and arrival times, delays, cancellations, baggage, live aircraft positions, weather, and delay predictions — that is sourced from independent third-party providers (including AviationEdge, the adsb.lol community ADS-B network, and Open-Meteo) together with computed estimates. SKYGATE does not generate this data, has no control over it, and cannot independently verify it.

You use the flight information shown in SKYGATE entirely at your own risk. Neither SKYGATE, Hugo Moriceau, nor the data providers are responsible for missed flights, missed connections, denied boarding, additional costs, or any other loss arising from reliance on, or from errors, gaps, or delays in, the information shown.

5. Compensation estimates & AI Rescue

The AI Rescue feature provides non-binding estimates of compensation you might claim under regulations such as EU261, UK261, and US DOT rules, and can help you draft a complaint email. It is a convenience tool — not a service that assesses, files, or pursues claims.

6. Acceptable use

You agree not to misuse the app, including by attempting to disrupt or overload third-party data services, circumventing usage limits, or using the app for any unlawful purpose.

7. Intellectual property

The SKYGATE name, logo, design, and software are owned by Hugo Moriceau and protected by applicable intellectual-property laws. Flight, position, and weather data remain the property of their respective providers.

8. Disclaimer of warranties

SKYGATE is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. Third-party data services may change, be unavailable, or be discontinued at any time.

9. Limitation of liability

To the maximum extent permitted by law, Hugo Moriceau and SKYGATE shall not be liable for any indirect, incidental, special, punitive, or consequential damages, nor for any loss of data, profits, time, money, missed flights, missed connections, denied boarding, rebooking or accommodation costs, or other loss, arising from or related to: (a) your use of, or inability to use, the app; (b) reliance on any flight information, schedule, gate, time, alert, delay prediction, or other data shown in the app; (c) errors, gaps, delays, unavailability, or inaccuracies in third-party data (including AviationEdge, adsb.lol, and Open-Meteo); (d) the non-delivery, delay, or duplication of notifications or Live Activities; or (e) any compensation estimate, drafted message, or claim outcome connected with AI Rescue. To the extent liability cannot be excluded, it is limited to the amount you paid for SKYGATE in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable mandatory law (such as for fraud or for death or personal injury caused by negligence).

10. Indemnification

You agree to indemnify, defend, and hold harmless Hugo Moriceau and SKYGATE from and against any claims, demands, losses, liabilities, and expenses (including reasonable legal fees) arising from or related to: (a) your use or misuse of the app; (b) any compensation request, complaint, message, or correspondence you send to an airline, regulator, or other party (including text drafted with AI Rescue); (c) your reliance on information shown in the app; or (d) your violation of these Terms or of any applicable law or third-party right.

11. Changes to the app or Terms

We may update, modify, or discontinue features of SKYGATE, and may revise these Terms from time to time. Material changes will be reflected here with an updated date. Continued use of the app after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to its conflict-of-laws rules. To the extent permitted by applicable mandatory consumer law, the courts of Switzerland shall have jurisdiction over any dispute arising from these Terms or your use of the app. This does not deprive you of any protection granted by mandatory provisions of the law of your country of residence.
